1. General Terms and Conditions
IntelligentVIEW Platform Subscription and Data Access – Terms and Conditions
These Terms and Conditions (“Agreement”) govern your use of the intelligentVIEW platform and access to the intelligentVIEW data, provided by Consumer Intelligence Group Inc. (“Provider”). By accessing or using the intelligentVIEW platform and/or intelligentVIEW data, you (“Subscriber” or “End User”) agree to the terms outlined below.
1. License
1.1 Grant of License: Provider grants Subscriber a non-exclusive, non-transferable, revocable, and limited license to access and use the intelligentVIEW platform and data solely for the purpose set out in the End User Contract (“Permitted Purpose”) for the duration of the Agreement.
1.2 Term of License: The license is valid for the term specified in the subscription contract. Upon expiration or termination of the Agreement, all rights granted under this license will immediately terminate.
2. Permitted Use and Restrictions
2.1 Permitted Purpose: The Subscriber agrees to use the intelligentVIEW platform and data only for the Permitted Purpose defined in the End User Contract. Any use beyond the Permitted Purpose or unauthorized access, duplication, or distribution of the data is strictly prohibited.
2.2 Prohibited Actions: The Subscriber agrees not to:
- Reverse engineer, disassemble, or otherwise attempt to derive the source code of the intelligentVIEW platform or data.
- Use the platform or data in any way that violates applicable laws or infringes on third-party rights.
- Sell, sublicense, rent, or otherwise make the intelligentVIEW platform or data available to unauthorized third parties.
3. Data Privacy and Compliance
3.1 Privacy Compliance: Provider certifies that all data and outputs provided through the intelligentVIEW platform comply with applicable privacy and data protection laws.
3.2 Data Security: Provider maintains appropriate safeguards to protect the data and outputs against unauthorized access, use, or disclosure.
3.3 Data Retention and Removal: Subscriber agrees to remove all data and outputs provided through the intelligentVIEW platform from its systems and any backup copies within 30 days of contract expiration or termination.
4. Warranty Disclaimer
4.1 “As Is” Provision: The intelligentVIEW platform, data, and outputs are provided “as is” and without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
4.2 No Guarantee of Results: Provider does not guarantee that the platform, data, or outputs will meet Subscriber’s requirements or that their use will lead to any specific results.
5. Limitation of Liability
5.1 Liability Cap: Provider’s liability under this Agreement, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Subscriber under the Agreement for the term during which the claim arose.
5.2 Exclusion of Damages: Provider shall not be liable for any indirect, incidental, special, or consequential damages arising from Subscriber’s use of the intelligentVIEW platform or data, even if Provider has been advised of the possibility of such damages.
6. Term and Termination
6.1 Term: This Agreement is effective as of the date of subscription and remains in effect for the term specified in the subscription contract, unless terminated earlier in accordance with these Terms and Conditions.
6.2 Termination for Breach: Provider may terminate this Agreement immediately if Subscriber breaches any term of this Agreement. Upon termination, Subscriber’s access to the intelligentVIEW platform and data will be disabled.
6.3 Data Deletion Upon Termination: Upon termination or expiration of this Agreement, Subscriber must delete all data, outputs, and associated files from its systems within 30 days.
7. Miscellaneous
7.1 Governing Law: This Agreement is governed by the laws of Ontario, Canada.
2. Privacy Policy
Who We Are
Consumer Intelligence Group Inc. (CiG) provides data-driven marketing insights through anonymized, geo-demographic, and survey data at the postal code level. Based in Canada, CiG has over 14 years of experience in delivering compliant marketing data and analytical solutions.
CiG Privacy Principles
CiG is committed to protecting privacy in accordance with Canadian laws, including PIPEDA, CASL, and Quebec Law 25, and closely monitors changes to ensure ongoing compliance. Our privacy principles are:
No Use or Collection of Personally Identifiable Information (PII): CiG processes only non-PII data from trusted sources. All data is anonymized or aggregated at the postal code or dissemination area level before use in CiG products and services. CiG does not collect, use, or disclose any PII.
Trusted Data Sources: CiG acquires privacy-compliant, anonymized, and aggregated data from reputable data partners. These sources may include census data, survey data, geographic data, and location-based data, collected with appropriate consents by our data partners.
Data Retention: Data from our partners is stored only as long as needed for the permitted purposes, in alignment with our End User Agreement. CiG does not intentionally or unintentionally collect or store PII, and the intelligentVIEW platform is designed to prevent any PII uploads.
Restricted Data Access: Access to data is limited to authorized CiG personnel for specific permitted uses.
Data Security Measures: CiG employs strong security measures to protect data, including:
- Firewalls
- Encryption
- Anti-virus software
- Role-based access controls
- Employee privacy and security training
- Intrusion detection systems
- Secure hosting on a major cloud vendor with a proprietary architecture
Data Sources
CiG collaborates with select data partners to enhance its intelligentVIEW platform, using aggregated sources such as census and geographic data to estimate demographic attributes at the postal code level. Additionally, CiG receives Identifier for Advertisers (IFA) data collected with user consent via electronic devices, ensuring compliance with privacy regulations.
Use of Identifier for Advertisers (IFA) for Digital Media Activation
CiG uses anonymous IFA data for media targeting at a postal code level. IFA data is controlled by end users and does not allow individual identification. These data are encrypted at rest and hashed during transfer, with no additional information shared with intelligentVIEW users. IFA audiences are aggregated by postal codes and transferred without identifying information. End users retain full control over their IFA settings.
Opting Out of Marketing Communications
Consumers can manage marketing preferences through the following services:
- Mail: CMA’s Do Not Mail Service – Do Not Mail Service
- Telemarketing: National Do Not Call List – National Do Not Call List
- Unaddressed Mail: To stop receiving unaddressed mail, place a note on your mailbox.
Control of Identifier for Advertisers (IFA)
Users can manage their IFA through their device settings:
- Revoked: Withdraw consent for IFA use.
- Regenerated: Create a new IFA.
- Deleted: Remove their IFA.
- Restricted: Limit targeted advertising.
iOS and Android allow users to reset or delete their IFA at any time.
